This website is operated by the FAFSWAG Arts Collective trading as FAFSWAG Limited. These terms and conditions govern the sale of limited edition art prints available for purchase on Fafswag.nz (referred to as "the website"). By placing an order, you agree to be bound by these terms.
2) Product Information
Fafswag.nz offers limited edition art prints created by various artists. The website aims to provide accurate and detailed product information, including dimensions, materials used, and edition numbers.
3) Ordering Process
By placing an order on the website, you are making an offer to purchase a product. Orders are subject to availability and acceptance by Fafswag.nz. Once an order is placed, you will receive a confirmation email detailing your purchase and acknowledging receipt of the order. This email is not an acceptance of your order, but rather a confirmation of its receipt.
4) Pricing and Payment
All prices listed on the website are in NZD and inclusive of applicable taxes once you check out. Prices do not include shipping and handling fees, which will be added to the total purchase price during checkout. Payment for orders must be made at the time of purchase. Fafswag.nz accepts payment via Credit Card, Visa, Master Card, Paypal, Apple Pay, After Pay.
All our pricing is in New Zealand Dollars (NZD,) and we reserve the right to change pricing or items on offer without notice. Taxes are included in our pricing.
When you checkout using one of your cards no information is stored by us. PayPal and Sprite use data encryption and anti-fraud technology to keep your information secure, reducing the risk of online fraud. Customers engage in these services at their own risk.
5) Shipping and Delivery
Fafswag.nz will make reasonable efforts to ship orders to the address provided within the estimated timeframe specified at the time of purchase. However, delivery times may vary based on location and other factors beyond our control. The risk of loss or damage to the product passes to the customer upon delivery.
International orders are currently unavailable, until fafswag.nz is able to expand our sales capacity. For the meantime Fafswag.nz will only be accepting orders within New Zealand. Orders may take a maximum of two weeks to arrive and a minimum of five work days from the date of order. Fafswag.nz does not accept any responsibility for delays to this process caused by any external factors.
6) Returns and Refunds
Fafswag.nz aims for customer satisfaction. If you are not entirely satisfied with your purchase, please please use the contact form on this site, or email fafswagprojects@gmail.com to discuss options for return or exchange.
Returns are accepted for products that are in their original condition and packaging. The customer is responsible for return shipping costs unless the product is damaged or defective upon receipt.
While all due care is taken to represent our products as accurately as possible, there may be times beyond our control where there are discrepancies. If you have received a product you believe to be faulty, please use the contact form on this site, or email fafswagprojects@gmail.com and we will be in touch to discuss a resolution.
7) Intellectual Property
All intellectual property rights, including copyrights, remain with the respective artists. The purchase of a limited edition art print does not grant the buyer any rights to reproduce or distribute the artwork.
8) Limitation of Liability
Fafswag.nz shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to the purchase or use of the products sold on the website.
9) Governing Law
These terms and conditions are governed by the laws of New Zealand, and any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts and the consumer guarantee act as well as the fair trading act of 1986.
10) Modification of Terms
Fafswag.nz reserves the right to update or modify these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on the website.
